Terms of Service

1. Acceptance of Terms

By accessing or using fetestprep.com (the "Site"), the FE Test Prep web application, or the FE Test Prep Android app (collectively, the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms form a binding agreement between you and FE Test Prep ("we", "us", "our").

2. Description of the Service

FE Test Prep is an independent study tool that provides practice questions, practice exams, study guides, and related educational content for the NCEES Fundamentals of Engineering (FE) and Professional Engineer (PE) exams. We currently cover 11 engineering disciplines (6 FE and 5 PE).

The Service is offered on a one-time-purchase basis per discipline. Purchasing access to one discipline does not grant access to other disciplines.

3. Not Affiliated with NCEES

FE Test Prep is an independent product. We are not affiliated with, endorsed by, sponsored by, or otherwise officially connected to the National Council of Examiners for Engineering and Surveying (NCEES), Pearson VUE, any state licensing board, or the publisher of any official reference handbook. "FE" and "PE" refer to the Fundamentals of Engineering and Professional Engineer exams administered by NCEES. All questions, explanations, and study materials on the Service are original content created for practice purposes and do not reproduce material from any copyrighted exam or publication.

The in-app Quick Formula Reference is an independent study aid for formula lookup practice. It is not the official NCEES reference handbook, design standard, code book, or exam-day reference material. Use the official materials provided through NCEES, MyNCEES, Pearson VUE, or the applicable standards publisher for exam-day rules and authoritative reference content.

4. Account, License Keys, and Access

When you purchase access, we issue a license key tied to your email address and the discipline you purchased. Your license key is your account credential. You are responsible for keeping your license key confidential and for all activity that occurs under your license.

Each license activates up to a limited number of devices. If you exceed the device limit, you may need to contact us for a reset. Using a private/incognito browser session may consume a new activation.

You agree not to share, resell, sublicense, publish, or distribute your license key. Sharing a license key with non-purchasers, posting a key publicly, or attempting to circumvent license validation may result in revocation of your license without refund.

5. Pricing, Payment, and Refunds

Current pricing is displayed at the time of purchase on the Site. Payments are processed by Stripe on the web and by Google Play Billing in the Android app. We do not store credit card numbers or full billing details.

Refund Policy. If the Service is materially broken for you and we cannot fix it within a reasonable time, contact us at feexamtestprep@gmail.com and we will issue a refund. Routine refund requests within 14 days of purchase are honored in good faith. We do not issue refunds for claims of "I did not pass the exam" unless you meet the documented criteria of our Pass Guarantee (see the Guarantee page on the Site).

Pricing Changes. Pricing, features, and the access model are subject to change as the Service evolves. We will not retroactively charge existing customers. We cannot guarantee that today's pricing, feature set, or access terms will remain identical indefinitely. Existing customers will be notified in advance of any material changes to access terms.

6. Acceptable Use

You agree not to:

Reverse engineer, decompile, or attempt to extract the source code, question banks, or answer keys of the Service beyond what is visible in normal use.
Scrape, crawl, or systematically copy questions, explanations, or other content for republication, redistribution, or training of machine-learning models.
Use automated tools to create accounts, activate licenses, or generate usage that does not reflect genuine study activity.
Resell or sublicense the Service or any portion of it.
Use the Service to infringe on the intellectual property rights of any third party, including NCEES.
Use the Service to harass, abuse, or harm other users or our staff.
Attempt to gain unauthorized access to any portion of the Service, other users' accounts, or our infrastructure.

We reserve the right to revoke a license and terminate access without refund for material violations of this section.

7. Intellectual Property

All content on the Service — including practice questions, step-by-step solutions, explanations, diagrams, calculator walkthroughs, study guides, and blog articles — is the original work of FE Test Prep and is protected by copyright. You may use this content for personal, non-commercial study purposes only. You may not republish, redistribute, or create derivative works without our written permission.

Trademarks, service marks, and logos referenced on the Site (including "NCEES", "Pearson VUE", "TI-36X Pro", "Casio", and calculator or reference book brand names) are the property of their respective owners. We reference these names only where accurate and necessary to describe exam-relevant products or context.

8. Educational Purpose and No Guarantee of Passing

The Service is intended for educational and exam preparation purposes only. While we work hard to align our questions with the current NCEES exam specifications, we make no representation that the Service alone is sufficient to pass any exam, that any specific question will appear on any actual exam, or that using the Service guarantees any particular exam outcome. Individual results vary based on prior knowledge, study habits, test-taking ability, and exam conditions.

Any "Pass Guarantee" offered on the Site is subject to its documented eligibility criteria and is separate from, and additional to, these Terms.

9. Third-Party Services and Links

The Site links to third-party services including Stripe (payments), Google Analytics (analytics), Google AdSense (advertising), Google Play Billing, Amazon (affiliate product links), and linked reference sites. We are not responsible for the content, policies, or practices of third-party services.

Some links on the Site are Amazon affiliate links. If you click an affiliate link and make a purchase, we may receive a small commission at no additional cost to you. See our Affiliate Disclosure for details. Affiliate relationships do not influence our editorial content.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains what data we collect and how we use it. By using the Service, you also agree to the Privacy Policy.

11. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or correctness of content. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components, or that every answer or explanation is free of errors. Where we identify an error, we update the content. If you find an error, please contact us.

12. Limitation of Liability

To the maximum extent permitted by law, FE Test Prep and its owners, employees, and contractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost profits, lost opportunities, exam outcomes, study time, or data loss, arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid us for the Service in the twelve months preceding the claim, or one hundred U.S. dollars (USD $100), whichever is greater.

13. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be announced on the Site. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Termination

You may stop using the Service at any time. We may suspend or terminate your access for material violations of these Terms, for fraudulent or abusive activity, or if required by law. Termination for a material violation does not entitle you to a refund.

15. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict-of-law provisions. Any dispute arising out of or related to these Terms shall be resolved in the state or federal courts located in Florida, unless otherwise required by applicable consumer-protection law.
